As foreshadowed in our letter of 25 May 1993 on patent reforms in Hong Kong, we are writing to discuss certain practical aspects of the Patent Cooperation Treaty

(PCT) once HK has its own patent system.

Background

Hong Kong's existing patent system provides for the re-registration in Hong Kong of United Kingdom patents granted by the UK Patent Office (UKPO) and European patents designating the United Kingdom granted by the European Patent Office. Applicants have to comply with minimal formal requirements. The patent remains in force in HK as long as it remains in force in the UK.

The PCT was applied to HK by the United Kingdom as from 15 April 1981. For PCT purposes, the receiving office for HK is currently the UKPO. The question of the continued application of the PCT has not yet been raised with the Chinese side as we preferred to defer this until after the issue of the PSC Report and the Administration has had the opportunity to consider policy options in the light of the consultation exercise. The timing for discussion with the Chinese in the IRO Sub-Group can be determined when we have considered further the PSC recommendation outlined below.
