HONG KONG: PATENTS REFORM
1.
We spoke today about the proposal for Hong Kong to change its status under the Patent Cooperation Treaty (PCT). I enclose a copy of our departmental legal adviser's opinion on this subject. As you can see she suggests that we should discuss with the Legal Adviser of WIPO the basis for his advice that Hong Kong could not become a separate receiving office. I would be grateful if you could discuss with the DTI whether it would be possible for you to discuss this informally with the WIPO Legal Department. I should also be grateful for your views as to whether there would be any practical problems were Hong Kong either to become a separate receiving office or to become a branch office but using different International Search Authorities and Preliminary Examination Authorities from those used by the UK.

(2) of the PCT.
2. I will need to respond to Hong Kong soon about there request. But I will need your views on the above before I can be in a position to do so.
