Further to my letter of 16 December, please find enclosed our substantive comments on the proposals of the Patents Steering Committee for localising Hong Kong's patent system and on the question of the continued application of the Patents Cooperation Treaty (PCT) to Hong Kong. We were very grateful to be consulted on these issues and are sorry for the delay in sending you our considered views. We nevertheless trust that our comments can be reflected in changes to the draft paper which you have now prepared for consultation with the Chinese.

2. We note that you intend the question of establishing a receiving office in Hong Kong for the purposes of the PCT to be the subject of separate consultations. Do you consider that your localisation proposals could be implemented regardless of Hong Kong's future position under the PCT?
