1997. The British side therefore proposes to introduce a Bill to

localise those provisions. The localising Ordinance, if enacted,

will make it an offence in Hong Kong for a person, of whatever

nationality, to do any act, in Hong Kong or elsewhere, which

constitutes the offence of hostage-taking, and make ancillary

provisions.

The localising Ordinance will not confer on an authority

in Hong Kong any powers formerly held by an authority in the United

Kingdom. It will however, if enacted, have extraterritorial effect

in that, as required by the Convention, an offence under the

Ordinance committed outside Hong Kong will be an offence under Hong

Kong law and triable by the Hong Kong courts if the offender is

brought within the jurisdiction of those courts.

Fugitive Offenders

As mentioned in para. 3 above, provision to make offences

under the 1982 Act extraditable in Hong Kong was made by the 1985

Extradition Order which, in relation to States in respect of which

the Convention is in force, made such offences extraditable under

the Extradition Acts 1870 to 1935. As the Chinese side is aware,

the 1985 Extradition Order and all similar Orders will lapse on 30

June 1997 and discussions have therefore taken place between the

British and Chinese sides on the legal arrangements for the

surrender of fugitive offenders to and from Hong Kong after that

date. A consultation paper on the British side's proposals for a

Surrender of Fugitive Offenders Bill was handed over to the Chinese
