Ms Rutherford would also like to see a provision that extradition applications are to be dealt with subject to the law of the requested party, and that no person shall be extradited until it has been thus decided, including with regard to any law as to the sufficiency of evidence and to the expiration of any further period which may be allowed (ie for appeal proceedings) that he or she is liable to be extradited. Ms Rutherford said such a provision would preserve the Secretary of State's discretion in the face of the document. Mrs Evans will draft such a provision, copying it to Miss Brooks.
