1. Thank you for your minute of 30 November enclosing a draft definition of investors. I have discussed with DTI'S
International Trade Policy Division the prospect that, under the proposed IPPA, PRC nationals with the right of abode in Hong Kong may qualify for protection by Hong Kong. The initial reaction is that there would be no policy objection: the UK welcomes inward investment and, in practical terms, it seems unlikely that there need be differentiation in this context between Chinese nationals with the right of abode in Hong Kong and PRC investors generally who would qualify for protection under the UK/China IPPA. I shall let you know if DTI have further thoughts.
2. Meanwhile, as agreed, I attach a copy of our IPPA negotiating brief plus copies of recent IPPAS with the United Arab Emirates, Ukraine, Barbados and Nepal (I would appreciate return of the published IPPA texts in due course, if possible).
