the CFA

JLG Agreement on the CFA

The Joint Communique following the Prime Minister's

Visit to China on 2 to 4 September 1991 recorded that the

British and

Chinese Governments had agreed in principle to

the early

establishment

of the CFA in Hong Kong. At the

Expert Talks on 9 to 10 September 1991 and subsequently at

JLG XX (24-26 September 1991), the two sides confirmed their

agreement to the following points of detail –

-

(a) The two sides agreed to the establishment of the

СТА before 1997 (but the Chinese side declined to

agree to any specific timetable).

(b)

the question of restrictions on jurisdiction of

the CFA over acts of state, the two sides agreed to

maxe provision for this in the legislation

establishing the CFA and would discuss specific

wording when it came to drafting the CFA ordinance.

(c)

On the question of including in the legislation

establishing

the CFA provisions mirroring the

provisions of Article 158 (3) of the BL, the Chinese

side agreed that it would not be possible for the

British side to

before 1997.
