Both the Chief Justice and the Attorney General are strongly of the view that the appointment procedure laid down in the JD and the BL should be delayed until 1997. Their concern is that if the Legislative Council were given the right to endorsement there is no guarantee that the undignified and very often sensationalised vetting procedures for senior judges adopted by other legislatures would not happen in Hong Kong. Good candidates might be deterred from applying or letting their candidature go forward. The Attorney General believes that it would be inadvisable to throw open the Judiciary now to the heat and clamour of politics - an inevitable consequence if BL 90 or a modified version of it were to be adopted now.
