3. In replying to the Hong Kong Government we should agree with what they propose. We should, however, note that the Hong Kong (Legislative Powers) Order 1989 does already enable them to legislate so as to give effect to an agreement on surrender of fugitive offenders, and we should point out that they only need this amending Order because the Commonwealth scheme depends not on interlinked agreements, but on parallel legislation.
I would be grateful if Ms Barrett, to whom I am copying this minute, would kindly take on the preparation of the Order.
