Present Law

General conditions governing the holding of public meetings are prescribed in the Public Order (Public Meetings)

(General Conditions) Order. CP can impose additional conditions. (Section 11)

On public processions, general conditions are set out in section 15. CP can impose conditions on the forming, conduct, route, times of passing and dispersal of the processions.

He has

discretion to amend such conditions.

Any person aggrieved by a prohibition of notified meeting, a refusal of procession licence or a cancellation/amendment of. licence may appeal to the Governor.

The wearing of uniforms connected with political organizations or objects is prohibited. (Section 4)

A person charged with certain specific offences under Part III is presumed to have done or omitted to do any act knowingly unless proved otherwise. (Section 17A (4))

Proposed Changes

The Public Order (Public Meetings) (General Conditions) Order is to be repealed. Sections 11 nd 13-15 are to be replaced by provisions setting out the fundamental requirement:/ obligations of organisers and participants, and allowing CP to impose conditions only to the extent necessary in the interests of public safety, public order, the protection of public health or morals or the protection of the rights and freedoms of others.

The present appeal procedure is modified to include a right of appeal against any condition imposed by CP and to restrict the general right of appeal to persons connected with the organization or conduct of the event.
