Nature of Problem
Various provisions in prisons rules, and standing orders may be liable to challenge.
(a) Police power to stop
entertainment "for any reason whatever" may be inconsistent with BOR, under which restrictions shall be such as are provided by law and are necessary.
(b) wide discretion of the
Commissioner for Television and Entertainment Licensing over the issue of permits for public entertainment.
Unequal treatment against ex- convicts relating to powers of search and evidential proof in respect of ex-convicts handling stolen goods.
Relevant Action
Amendments to a number of rules and standing orders relating to censorship of prisoners' correspondence and disciplinary offences are expected to be finalised soon.
The Recreation and Culture Branch will take on board BOR issues in the course of its current general review of the Ordinance. It is expected that the amending legislation can only be introduced in 1993/94 at the earliest.
