There are queries whether certain provisions in s. 18(3) and parts VIIA and VIIB are compatible with the BOR. example, the statutory presumptions of quilt relating to trafficking in illegal immigrants may be inconsistent with Article 11 of the BOR). These provisions are designed to enable (a) repatriation of Vietnamese migrants and (b) effective action be taken against illegal immigrants and "snakeheads". When they were
first enacted, it was provided that they would expire automatically at the end of the year unless extended for another year by positive resolution of Legob. They have been extended every year up to now.
Relevant Action
With the no. of Vietnamese migrants dwindling, Secretary for Security will review these provisions with a view to retaining only those powers justified and necessary to combat the long-term illegal immigration problem from China.
