The Council, at the fifteenth meeting of its 137th Session on 18 December 1992, considered C-WP/9684 and C-WP/9685 on the subject of the shooting down of the Korean Air Lines Boeing 747 (flight KE 007) on 31 August 1983 and decided (C 137/15) to complete the fact-finding investigation which ICAO initiated in 1983. The Council instructed the Secretary General to request all parties involved to co-operate fully with the Organization in turning over to ICAO, as soon as possible, all relevant materials, including the original tapes of the cockpit voice recorder (CVR) and digital flight data recorder (DFDR). The Council further instructed the Secretary General to undertake the investigation on an urgent basis and report back to the Council as soon as possible.

2.1

COMPLETION OF INVESTIGATION

Immediately following the Council decision, an investigation team was designated comprising three staff members and a consultant on a full-time basis, and one staff member and a consultant on a part-time basis. Other officers of the Secretariat assisted as required.

In a memorandum to Representatives on the Council from the Secretary General dated 28 January 1993, certain factual information was provided on the steps taken in this regard as of that date.

On 22 March 1993, the Council (C 138/15) examined an interim report, presented by the Secretary General in C-WP/9742 Restricted, on the progress of the completion of the fact-finding investigation. The progress of the investigation effort, as reported in C-WP/9742 Restricted, included the hand over of the CVR and the DFDR tapes by the Government of the Russian Federation to ICAO, and arrangements made with France regarding the read-outs and processing of the flight recorder tapes at the Bureau Enquêtes-Accidents (BEA) and the Centre d'Essais en Vol de Brétigny-sur-Orge (CEV). C-WP/9742 Restricted also reported on the bilateral discussions with the four Observer States and the gathering of additional information which had become available since the investigation in 1983. In summary, the ICAO team visited the United States of America from 28 to 29 January 1993 for a series. of meetings held at the Headquarters of the National Transport Safety Board (NTSB) in Washington, D.C., and attended by officials of the NTSB, Department of State, Department of Defense and the Federal Aviation Administration (FAA). The team was in the Republic of Korea from 4 to 7 February 1993 and met with officials from the Ministry of Foreign Affairs, the Ministry of Transportation and Korean Air. The team, which arrived in Japan on 7 February 1993 and departed on 10 February 1993, met with officials of the Ministry of Foreign Affairs, the Ministry of Transport and the Defense Agency. The ICAO team held meetings in the Russian Federation with officials from the Interstate Aviation Committee and the Ministry of Defense on 11, 12 and 13 February 1993. On 12 February, the team also met with three of the divers who were involved in the search for, and retrieval of, the flight recorders.

Three members of the ICAO team continued the read-out work and the analysis of DFDR data in Paris, France from 15 to 19 February 1993.
