In anticipation of a successful
outcome of our
coming talks with the US, I have prepared a first draft of the following :-
(a)
a UK/US Memorandum of Consultations to bring the HK/US arrangements
into provisional effect under
the UK ASA; and
(b)
3 UK/US Exchange
above) to effect
of Notes (aş Annex 2 to (a) consequential amendments to the
UK/US ASA when the HK/US ASA enters into force.
Drafting
these two documents turned out to be less than straightforward as we are wary of the past US unyielding stance in retaining a RTW route in the overall package. You will notice from paragraph 1(ii) of the draft UK Note that we have not included provisions to delete "Hong Kong" from segment (b) of US Route 2 (RTW combination service). This we believe is not absolutely necessary. As long as we do not concede the corresponding rights for RTW service in the Hong Kong/US ASA, the retention of "Hong Kong" on that route segment alone could not enable US carriers to make profitable use of such rights.

the Memorandum Of Until the HK/US ASA enters into force, "Hong
Kong" will remain a point on US Route 2 and therefore will remain technically available to US carriers. The Memorandum therefore must provide for the substitution of the new HK/US arrangements for both the arrangements for US Route 2 as well as routes mentioned in paragraph 1(ii) of the Exchange of Notes. The prepared draft is we believe the most oblique way of achieving this without expressly mentioning the RTW route.
