HK/AUSTRALIA ASA: UK/AUSTRALIA EXCHANGE OF NOTES

Telno 1026 from Hong Kong asks us to set in motion the exchange of notes with the Australians to remove Hong Kong from the UK/Australia ASA.

Looking back at the files, there were two draft Exchanges of Notes, both cleared with John Grainger at FCO Legal. The UK version simply deleted Hong Kong routes from the route schedule and the Australian version (for avoidance of doubt resulting from any future route changes) appended a replacement route schedule. On 17 June 1992 David Moss wrote to David Buckingham in Australia proposing that a revised version of the Australian draft provided ((b) of the second paragraph of his letter) that agreement had been reached on new trunk route arrangements. In the absence of such agreement, the UK draft would need to be used. In the event, as you know, no agreement on route schedules was reached.

Mrs Fanning replied to Mr Moss on 13 October saying "we accept your amendments to our proposed draft exchange". It is not, therefore, clear that they have understood the caveats in that letter and realise that, in the current circumstances, the UK version has to be used.

I therefore attach a draft telegram for the High Commission in Canberra suggesting that they make informal soundings, prior to the sending of the draft exchange of notes, to ensure that there is no embarrassment.

You might like to show the draft to John Grainger prior to despatch in case he has any comments. A copy of the telegram needs to go to Martin Glass in Hong Kong so that he is aware of the developments.
