I then raised the related issue of provisional application of the Draft Hong Kong/Thailand Confidential Memorandum of Understanding (CMU) that had also been agreed tentatively in December 1990.
That was our normal procedure pending
pending signature of a separated ASA, and it enabled the airlines of each side to make immediate use of the rights that had been exchanged. Although the market had not increased as fast as had been anticipated at that time, and we might at some stage need to reconsider the capacity provisions in the light of that, the CMU provided a firmer and more comprehensive basis for operations by the airlines of each side, including the Chiang Mai and Phuket services, than the 1985 UK/Thailand CMU.

You mentioned that consideration was being given setting up of an all-cargo airline in Thailand, and we noted that the capacity provisions of the draft Hong Kong/Thailand CMU included five all-cargo frequencies for each side which would accommodate operations by such an airline when designated.
Should you be interested in the provisional application of the CMU at this stage, therefore, I enclose a suggested draft exchange of letters that would give effect to this. The exchange is between the UK and Thai authorities as the application of the new arrangements needs to be under the UK/Thailand ASA until the Hong Kong/Thailand ASA is signed. The implementation of these arrangements is, however, the responsibility of Hong Kong and Thailand.
