GRANTING OF AUTHORITY TO HONG KONG TO NEGOTIATE AIR SERVICES AGREEMENTS WITH NEW COUNTRIES
1. I attach copies of correspondence relating to Hong Kong's request for authority to negotiate Air Service Agreements with countries outside the separation programme. At the moment, they are required to obtain approval in each case from the Department of Transport.
2. Shelagh Brooks, the Legal Counsellor dealing with this, has raised the question of what would happen if Hong Kong entered into negotiations with a country which the UK would rather it did not. Joanne Othick of the DOT thinks this is probably covered within the general relationship between the UK and Hong Kong but suggests we check the position with you before going ahead with submitting the Entrustment to the Secretary of State for signature.
