1. Thank you for copying me Ms Othick's letter of 9 November and previous correspondence on this subject. I agree that Ms Brooks has identified a potential problem. I do not believe that there is any precedent as to how to deal with this. However since the authorisation is only to negotiate and not to conclude or sign any agreements, I think we can rely on HKG's commonsense not to negotiate any ASAS with countries not recognised by HMG.
2. I agree that it might be wise for the letter covering the entrustment to refer to our wish to be informed of new negotiations. It might also be worth reminding Hong Kong that they will continue to require specific authorisation to sign each new ASA.
