CRIMINAL OFFENCES ON BOARD AIRCRAFT

Thank you for your letter of 23 December 1992 in which you comprehensively reply to the questions posed in respect of jurisdiction for offences committed on board Cathay Pacific aircraft, enroute Hong Kong to UK.

I much appreciated your attachments in respect of the Tokyo Convention Act and also that of the UK Civil Aviation Act 1982, which helped to identify the legal position in respect of the Cathay Pacific offences. However there still remains an element of doubt as to why, as a dependent territory, we can be subject to enforcement of UK Department of Transport Transec obligations and yet not be protected in a legal position involving criminal offences. I would however welcome your assistance in identifying who I should address on this anomalous position as I believe it requires resolution.

For your information, the saga of the particular offence that initiated this enquiry may lapse, due to the need for an extradition of potentially a person of unsound mind.

I shall relay the contents of your letter to my head office and to other interested parties.
