COPYRIGHT DESIGNS AND PATENTS ACT 1988: EXTENTION TO DEPENDENT TERRITORIES

1.

I attach a copy of a self-explanatory letter from the Patent Office asking that UK Dependent Territories be informed of the possibility of having extended to them the copyright provisions contained in Part 1 of the Copyright Designs and Patents Act 1988. I propose to ask the Patent Office to clarify what impli- cations, if any,

if any, there are for the DTS and to provide sufficient copies of the 1988 Act to enable each DT to receive a copy.

2. Subject to those two points, and subject to your views and those of the other recipients of this minute, I would propose to write on the lines of the second and third paragraphs of the Patent Office letter. The letter itself is clearly unsuitable for onward trasmission and its terminology will require some editing (eg deletion of "colony" and its substitution by "depen- dent territory" where appropriate).

13.

Unless you and other recipients advise otherwise, I would also propose to invite individual DTS to write direct to the Patent Office on any specifically technical aspects of the Act, copying any correspondence to the FCO for information.

4. I should be grateful for advice as to whom in each DT a letter should be addressed. HKD may conclude that Hong Kong should be left out of this exercise.
