HONG KONG: AMENDMENT TO SCHEDULE TO TRADEMARKS ORDINANCE

As discussed earlier this afternoon, I attach a copy of a a letter dated 7 July which we have received from Hong Kong seeking our views on proposed amendments to the Hong Kong Trade Marks Ordinance.

I have prepared the attached draft reply drawing on the advice I have received from our legal adviser. Paragraphs 6 and 7 deal with the problem of Yugoslavia. Our legal adviser has recommended that Hong Kong should leave "Yugoslavia" in the Schedule to the Trade Marks Ordinance. However, she has pointed out that this may mean that Bosnia-Herzogovena and Macedonia are not covered by the Convention. I would be grateful if you could tell me if either of them has sent a notification to WIPO about their present status under the Convention. According to the legal adviser, it is also possible that one or both has made a general declaration about its position in relation to treaties to which the SFRY was party by for a notification to the UN Secretary General, but WIPO would not necessarily be aware of this.

Lastly, as this is far from familiar territory to me, and I may not have expressed things correctly, I would be very grateful for comments on the draft generally.
