Authority This Order in Council was made on 25 July 1986 under the Trade Marks Act 1938, § 39A (7), Halsbury's Statutes, 4th edn Vol 48, title Trade Marks and Trade Names (s 39A was inserted by the Patents, Designs and Marks Act 1986, s 2 (2), Sch 2. para 5). Commencement 1 October 1986.
Aruendment This Order in Council has been amended by SI 1986/1890 and 2236, 1987/170, 1988/1856 and 1990/2593 listed at pp 2, 3 ante.
General This Order in Council lists the countries in which an application for registration of trade marks or service marks will give priority in respect of applications made in the United Kingdom within the following six months. So far as it relates to trade marks, the order replaces orders made under the Patents and Designs Act 1907, s 91A (repealed by the Patents, Designs and Marks Act 1986, s 3. Pt II) so far as they related to trade marks; see further the Preliminary Note to the title Patents and Designs in this work.

General These rules revoke and replace the Trade Marks Rules 1938, SR & O 1938/661, and amending SI 1964/227, 1975/229, 1980/1931. 1982/718, 1985/921. The rules govern the fication and registration of trade marks and service marks, the assignment or transmission of marks, registered users and other supplementary and procedural matters. They make mitutional provision in relation to Sheffield marks and textilè marks.
Preliminary
1. Citation and commencement These Rules may be cited as the Trade Marks and Service Marks Rules 1986 and shall come into operation on 1st Doober 1986.
