Roger Knights will have told you that I telephoned on Friday about an application by a cable programme service in Hong Kong for the law to be amended so as to provide protection for their originated cable programmes. IFPI understands that the Hong Kong authorities, and HMG, are, in principle, disposed to accede to the request and are considering how to implement it expeditiously, rather than wait until the new comprehensive copyright law for Hong Kong is completed and enacted. IFPI also understands that the Hong Kong authorities would be agreeable to extending the protection of sound recordings so that it covered the inclusion of a sound recording in a cable programme service. As you know, such amendments were made to the Copyright Act 1956 by the Cable and Broadcasting Act 1984.

The purpose of this letter is simply to place on record IFPI's formal application for such an amendment to be made. Subject to the Agreement between the Governments of the United Kingdom and the People's Republic of China on the future of Hong Kong it would appear that the most convenient way of implementing this request would be an order under the Copyright Act 1956 pursuant to paragraph 36(2) of Schedule I of the Copyright, Designs and Patents Act 1988.

I would be most grateful if you could keep IFPI informed on the progress of this matter, particularly if there appear to be problems.
