5. I would suggest that you copy Ms Au's letter to Mrs Sullivan and Mr Mungat and ask them to comment in particular we need Mr Mungat's reaction to paras 6-10. When Mr Whomersley returns I will see whether it is possible to reconcile the advice he gave on the 1990 Order and the view which Miss Brooks and I came to recently. However, I suspect that at the end of the day our conclusion will be that there is room for more than one legal view, and it will be for HKG to decide whether to live with the doubts or whether to take any remedial action.
6. I understand that our meeting on 18 October is with a representive of Recreation and Culture Branch. Presumably she will not be wanting to discuss the validity of the 1990 Order? Howevr, in case she does wish to, it would be helpful if you could have obtained a response from Mrs Sullivan and Mr Mungat, and have located the back files by the end of next week so that we can discuss the position on the morning of the
18th.
