EXTENSION OF THE COPYRIGHT ACT 1956 TO HONG KONG
1. Please see the attached letter dated 20 September from Miss AU King-Chi which explains that Hong Kong cannot agree with the advice in my letter of 13 August to Peter Harrison and asks for copies of the legal advice which I have received on the question of the legal effect of the Copyright (Hong Kong) (Amendment) Order 1990.

My legal Adviser, Jill Barrett has no objection to her minutes of 30 July and 6 August being copied to Miss AU King Chi, however she has asked me to check that you and Mr Mangat have no objections either as she has referred to your views in her minute of 6 August. I hope you will not object, as I think the minute makes clear that we have considered various arguments. If you agree to my copying the minute, I will emphasise in my covering letter that the most important point lies in paragraph 9; ie that there is room for more than one view, but since there is such doubt about the scope of the powers, it would be prudent not to rely on them.

Miss AU King-Chi refers in her letter to FCO and DTI legal advice given in 1989 and 1990 when the Copyright (Hong Kong) (Amendment) Order 1990 was made. We believe the FCO advice was given by Mr Whormersley, but unfortunately as he is away for a month on various overseas negotiations Jill Barrett has been unable to discuss the matter with him yet. The DTI advice was given by Mr Mangat (to whom I am copying this letter). I would therefore be very grateful for his comments on Miss AU King-Chi's letter. In particular we need his reaction to paragraphs 6-10. I have a meeting with Jill Barrett scheduled for 18 October and it would therefore be very helpful if I could have Mr Mangat's comments by the end of this week. We will consult Mr Whormersley when he
