INTERNATIONAL LABOUR ORGANISATION (ILO): ARTICLE 19 REPORTS 1994 ON CONVENTION NO 158

1.

Each year the British Government and its non-metropolitan territories are required under Article 19 of the ILO Constitution to submit reports on the position of law and practice in respect of certain selected ILO Recommendations and unratified Conventions.

This year the ILO has requested a report on Convention No 158 (Termination of Employment) and its associated Recommendation (No 166). I attach copies of these documents.

Hong Kong has not ratified this Convention. Its reports should therefore show the extent to which effect is already given to the provisions of the Convention and the Recommendation, whether it is proposed to give further effect to those provisions, and the difficulties which remain

preventing ratification of the Convention or application of the Recommendation.

4. I also attach a report form which provides details of the format in which the report should be completed. I should be grateful if you would arrange for the Hong Kong authorities to provide reports, answering the questions in the report form and describing the position in respect of this Convention for the period ending 30 June 1994. Copies of any legislation mentioned in the report should be enclosed, unless copies have already been sent to the ILO in connection with a previous exercise.

Following the receipt and examination of the report, the ILO Committee of Experts on the Application of Conventions and Recommendations will publish a survey setting out the position of ILO Member States in this field. This will be discussed by the Applications Committee at the ILO Conference in June 1995.

The Department of Employment have asked for the report to be with them no later than 11 March. I should therefore be grateful to receive it by 5 March.
