The laws and regulations described in the preceding paragraphs prescribe various penalties for contravention and are enforced by inspection undertaken by Factory Inspectors, Health Inspectors Radiation Board Inspectors.

Section 4 of the Factories and Industrial Undertakings Ordinance, section 16 of the Radiation Ordinance and section 126 of the Public Health and Municipal Services Ordinance provide for the powers of officers in inspection duties.

Existing legislation provides for the prevention and protection of employees against occupational hazards due to air pollution in various branches of economic activities, with the exclusion of marine transport and the primary industries in respect of agriculture, animal husbandry, forestry and fishing.

In the industrial sector, regular inspection services are undertaken by the Factory Inspectors of the Labour Department for the enforcement of the Factories and Industrial Undertakings Ordinance and its subsidiary legislation. Irregularities suspected are referred to the Occupational Health Division "for detailed assessment of the extent of contamination and advice on necessary precautionary measures. Ventilation in the working environment in both the manufacturing and services sectors is governed by Part VIII of the Public Health and Municipal Services Ordinance, and by certain regulations and by-laws made under the Public Health and Municipal Services Ordinance and the Buildings Ordinance.

No statistics have been kept exclusively in respect of inspection activities for the detection of air pollution in the working environment. The Factory Inspectorate conducts visits to workplaces for the enforcement of the provisions governing safety, health and welfare provided by

Factories and Industrial Undertakings Ordinance regulations made thereunder as a whole.
