There are

at present no legislative measures in Hong Kong to fix standard maximum number of hours of work. Hours of work are governed by the Articles of Agreement which are in a standard format and are required by sections 9 and 10 of the Merchant Shipping Ordinance for all Hong Kong registered ships. The Superintendent of the Seamen's Recruiting Office approves, as he deems it, the maximum number of hours of work submitted by the employer in the standard clauses and terms of service which form part of the Articles of Agreement entered into pursuant to sections 9 and 10 of the afore-mentioned ordinance. The watchkeepers and staff of the catering department generally work a maximum of 56 hours a week, whereas the day workers work a maximum of 44-46 hours a week.

With regard to the Committee of Experts' comment that legislative provisions governing hours of work on board ship should not be limited to watchkeepers, the Hong Kong

Government would like to report that the shipping industry, including shipowners' and seafarers' organisations, has been consulted in relation to this issue. The response from the industry is that the introduction of legislative measures to regulate the hours of work in respect of seafarers in general' would not be necessary and would duplicate the present administrative measures adopted by the Hong Kong Seamen's Recruiting Office to regulate the maximum number of hours of work. generally eight hours a day. These measures have been working very

well.
