As defined in section 2 of the Merchant Shipping (Recruiting of Seamen) Ordinance, Chapter 135, "foreign-going ship" does not include any ship employed exclusively in trading or going between any port of Hong Kong and any place or places situated within the following limits :-

(a) to the east, meridian 114°30'east;

(b) to the south, parallel 22°09' north; and (c) to the west, meridian 113°31' east;

but

any flag

save as aforesaid includes any foreign-going ship of any whatsoever whether or not the ship calls at any port of Hong Kong.

In the following items of legislation the term "sea-going ship" is interpreted as "a ship other than one which navigates exclusively in inland waters or in areas where port regulations apply" :-

Merchant Shipping (Certification and Watchkeeping) Regulations;

Merchant Shipping (Navigational Watch Ratings) Regulations;

Merchant Shipping (Engine Room Watch Ratings) Regulations;

Merchant Shipping (Tankers-Officers and Ratings) Regulations [where the term "sea-going tanker" means a tanker other than which navigates exclusively in inland waters or in areas where port regulations apply];

Merchant Shipping (Protective Clothing and Equipment)

Regulations;

The above-mentioned regulations apply also to sea-going tugs.

paragraph 4, subparagraph (c)

No proposals have SO far been made by shipowners and seafarers regarding exclusions from the scope of the convention of small vessels and vessels such as oil rigs and drilling platforms when not engaged in navigation.

subparagraph (a)

The Merchant Shipping (Safety) Ordinance, Chapter 369, is concerned with the safety construction and equipment of ships registered in Hong Kong. The ordinance consolidates various provisions of the Merchant Shipping Ordinance and the United Kingdom Merchant Shipping Acts which have been extended to Hong Kong by Orders in Council into a new code relating to the safety of ships.
