is entrusted with the responsibility of enforcing the legislative provisions for which this convention is being applied.

Article 5

Merchant

2(a) The laws and regulations are brought to the notice of the public through publication in the Government Gazette and through press coverage. They are brought more particularly to the attention of the parties concerned by the professional surveyors of the Marine Department at the time of inspecting the ship. Advice is freely available from the Shipping Division and the consultative committees of the Marine Department at any time.

2(b) The shipowners are responsible for complying with the laws and regulations to the satisfaction of the Director of Marine.

2(c) Sections 18 (5) and (6) of the Merchant

Shipping Ordinance prescribe a maximum fine of HK$10,000 for .contravention of the regulations with respect

the crew accommodation made under section 18:

2(d) Regulation 38(2) of the United Kingdom Merchant Shipping (Crew Accommodation) Regulations requires the master of a ship or an officer appointed by him to inspect the crew accommodation at intervals not exceeding seven days and to record the inspection in the official log book. Surveyors of the Marine Department are empowered to conduct

conduct inspections under circumstances prescribed in this section and also when the Director of Marine, has reason to . believe that a requirement of these regulations has

not been satisfied.

2(e) There is no provision for consultation with shipowners; shipowners' organisations or the bona fide trade unions of seafarers in Hong Kong.
