Section 2(j)(a) of the Factorics and Industrial Undertakings Crdinance exempts from compliance with this Ordinance undertakings which are not carried on by way of trade or for purpose of ain. These include technical schools as envisaged in this article.
In Hong Kong, educational institutions providing technical educa- tion come under either the Technical Education and Industrial Training Department, the Education Department or the Statutory Training authorities. All technical institutes and those vocational training centres which äre wholly financed by Government subventions come under the Technical Educá- tion and Industrial Training Department. The Construction Industry Training Centres and the Clothing Industry Training Centre cone under the Cons truc- tion Industry Training authority and the Clothing Industry Training Autho- rity respectively. Secondary schools offering technical and commercial subjects come under the Education Department.
The minimum age for admission to Form One classes in secondary schools offering technical subjects is 12 years but the average age of Form One students is approximately. 13 years. For technical institutes and voca- tional training centres, the normal age of admission is 15 years.
Regulations 4(1)(b) and 1(2) of the Employment of Children Regu- lations (Regulation 1 of the Factories and Industrial Undertakings Regula- tions prior to 1st September 1979) provide for the prohibition of employment of children in industrial undertakings (other than a registered school under the Education Ordinance) which are not carried on by way of trade or for the purpose of gain.
The supervision of students in workshops is govered by the Educa- tion Regulations made under the Education Ordinance, Chapter 279. Regula- tions 27 and 28 of the Education Regulations prescribe that no pupil shall be permitted to enter any school workshop or science laboratory unless a teacher is present and one teacher shall not teach more than 20 students at the same time in a school workshop without the prior approval of the Direc- tor of Education.
Regulation 21 of the Education Regulations provides for safety precaution measures for the operation of tools and machines in school work- shops. Regulation 55 of the same set of regulations provides for the proper fitting of first nid boxes outside and adjacent to all school workshops and requires all science teachers, workshop instructors and their assistants to be familiar with the contents of the first aid box and their use.

Until 30th June 1980, Regulation 15 in Part II of the Factories and Industrial Undertakings Regulations requires the proprietor of every industrial undertaking in which young persons are employed, to maintain a register of all such young persons employed therein. As from 1st July 1980, Part II of the Factories and Industrial Ündertakings Regulations was repealed and the provisions were incorporated into the Women and Young Parsons (Industry) Regulations made under the Employment Ordinance.
