Thank you for your letter of 22 January about the issue of Taiwan and the interpretation of the term "non-Parties" in EC Regulation 594/91.

When Maria Nolan spoke to you following her meeting with the Majestic Trading Company, she may have inadvertently given you the impression that the Commission will be amending the term "non-Parties" in the new Regulation which they are preparing, to reflect the wording in the Protocol of "any State not Party". This is what we hope the Commission will do. We have tried to contact DGXI at least a dozen times to find out what is being done, but have not been able to get through. We therefore do not actually know what DGXI's intentions are.

If the Commission's proposal for the new Regulation does not amend the reference to "non-Parties", then we may need to push for this to be included during the negotiations on the proposal. It is difficult for me to say whether there are likely to be any potential problems in reaching agreement on the interpretation of "non-Parties" with our EC partners. There is a general lack of understanding of the problems caused by the omission of the word "states", and I cannot say at the moment who is likely to support the UK view.

You also mention the issue of our Dependent Territories which have yet to ratify the London Amendment. On the assumption that we have ratified the 1987 Protocol on behalf of all our Dependent Territories, the only trade restrictions to apply will be those which come into force from

from 10 August 1993 under the London Amendment and the revised EC Regulation, in respect of Annex B
