MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETE THE OZONE LAYER

1. Please refer to my letter of 17 February about the data you provided for the Protocol Secretariat. I have now received comments, from DOE and our Legal Advisers; these are summarised below. A more detailed analysis prepared by DOE is attached at Annex A.

2. The following additional data will be required to demonstrate Hong Kong's compliance with the Protocol:

a) CFCS 11, 12, 113, 114, 115 and halons

Data is required to show that no substances have been imported from States not party to the Protocol since 1 January

1990.

b) Other fully halogenated CFCs, carbon tetrachloride, 1,1,1 trichloroethane and HCFCs

Strictly speaking there is no need for data for the period 1 July 1992 to 31 December 1992 to be provided. However we see considerable presentational gains in doing so and will include this data in the submission to the Protocol Secretariat.

3. Turning to the measures being implemented in Hong Kong to control ozone depleting substances, it is not clear from paragraph 3 (i) of your letter of 10 February whether the amendment to the Ozone Layer Protection Ordinance provides for the prohibition of exports from non-Parties; perhaps you could let me know. It would be useful if copies of the relevant legislation could be submitted to the Protocol Secretariat as evidence of the measures Hong Kong has taken to comply with the provisions of the Protocol. I should therefore be grateful if you would send copies of the amendment to the Ozone Layer Protection Ordinance and the Regulation referred to in paragraph 3(iv) of, your letter by fastest available means.
