MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETE THE OZONE LAYER

In my letter of 24 August I undertook to let you have any further comments on the legislation enacted by Hong Kong to implement the London Amendment to the Montreal Protocol. DOE Legal Advisers have considered the additional explanation contained in your letter of 12 August and have made the following comments.

a) Controls on consumption levels

We have no further comments to make.

b) Article 4.5 of the Protocol

Whilst the legislation contains no provision to implement Article 4 (8) of the Protocol, we

c) Reporting of data

The licence system seems adequate to compile data on imports and exports, but it is still not clear how data concerning amounts of controlled substances used for feedstocks would be collected. Whilst Hong Kong has no facilities for producing or destroying ozone depleting substances, feedstocks are used in the manufacture of other chemicals. It is not clear from your letter whether there are facilities in Hong Kong for the production of chemicals using ozone depleting substances.
