HKMAO is looking into the measure to allow expatriate civil servants to switch to local terms and the definition of "permanent residents". China and Britain must reach a consensus on such a definition in order to achieve convergence for the civil service.

The new arrangements have violated the JD and the BL, which clearly state that the original system of recruitment and employment for the public service should be maintained except for any provisions for privileged treatment of foreign nationals. The British side has also violated the JD by not consulting the Chinese side on the change beforehand.

The HK Government has not consulted the Chinese side prior to deciding on the new measures. Any informal notifications not made through proper channels such as the JLG, the British Embassy or the NCNA HK Branch cannot be taken as having consulted the Chinese side.

The HK Government should have consulted the Chinese side before announcing the new policy, which is a major change to the civil service system. The issue should be discussed by the JLG.

The move is detrimental to the localisation policy and is in violation of the spirit of the BL and the JD.

Local and expatriate civil servants have never been competing on a fair basis.

It is suspected that Britain is trying to have a share of power in the post-1997 administration.

The stability of the civil service is part of HK's smooth transition. The HK Government should consult the Chinese side through formal channels.

The British-HK authorities are trying to extend their administrative power beyond 1997 by "localising" expatriate civil servants and introducing a fully directly. elected Legco in 1995.
