stem from Section 10C(1) of the Independent Commission

Against Corruption Ordinance. This section states, inter alia, that " An officer authorised in that behalf by the

Commissioner may:-

(c)

seize and detain anything which such

officer has reason to believe to be

or to contain evidence of any of the

offences referred to in Section 10...."

Section 10 itself lists a number of criminal

offences under the Prevention of Bribery Ordinance, the

Theft Ordinance, and offences relating to conspiracy and

assisting offenders.

This Commission intends to retain the

property removed from the aforementioned safe deposit box

as evidence and until such time as Mr Uwe Kaiser has been

tried for the criminal offences for which he is wanted in

Hong Kong; however long that may take.

I hope this clarifies our position in this

matter. Please also be advised that I do not intend to enter

into any further discussions with you in respect of this

subject or the laws of Hong Kong.
