I enclose a copy of a letter which we have received from a Mr Klaus Kaiser about his sister, Judith Kaiser's efforts to regain her possessions from the ICAC. Mr Kaiser has enclosed
a letter dated 6 March 1991 from J J Shanahan of the ICAC which states that the ICAC intends to retain the property in question as evidence and until such time as Mr Uwe Kaiser, Judith's husband, has been tried for criminal offences for which he is wanted in Hong Kong.
I would be very grateful if you could let me know, if possible, the background to this case and the reasons why Mrs Kaiser's possessions are still being held by the ICAC. Has Mr Uwe Kaiser been brought to trial and if so, how does the outcome of the trial effect the status of Mrs Kaiser's possessions? If Mr Kaiser has not yet been brought to trial, does this mean that his wife's possessions will remain in the ICAC's custody for an indeterminable length of time?
As you will see Mr Kaiser has asked for "some positive assurance from a position of authority" that his sister's assets will be returned to her. Please could you let me know how I should reply to Mr Kaiser on this point, and give me any further advice on what we may tell him. Presumably we should straighten him out on the misconception that the ICAC is to be disbanded? But it would be helpful to be able to say a little more than this.
