I understand that you have taken over this matter from Sarah Haspel.

I have obtained the Law Officers' permission to forward a copy of the Opinion of Counsel, Mr David Unwin. This I now do.

Having considered the Opinion, the Solicitor General has indicated that a Direction under the Sign Manual may be appropriate although he will be looking for a Scheme that ensures that the wishes of the donor are properly observed. In particular, he considers at this stage that it is clear from the letter dated 10 March 1986 that the donor intended only the. interest to be paid over.

It is apparent and Counsel makes the point in paragraph 6 of his Opinion that it will be necessary to clarify how it is that the gift is to be administered. You will no doubt consider the options identified by Counsel in his Opinion and, having settled upon the required course, give me the necessary information. Although the gift is a sizeable one in capital terms, the income that it will produce will not be very great. That being so, the matter of expense raised by Counsel in paragraph 12 of his Opinion would seem to be important to bear in mind. The option identified in paragraph 13 would probably be most cost effective as avoiding the imposition of a further administrative layer.
