1. In your absence I received comments on Ms Haspels draft submission on setting up a Royal Sign Manual for the S K Tang bequest (draft attached) from CRD. In general they are content with the submission and raise only two points:
should we bring the British Council back into the picture at this stage by showing them the draft submission and thus assuring their cooperation?
when should we inform Hong Kong of our intentions to bring the bequest back to the UK?
I see no need to involve the British Council with our proposal until we have at least obtained an opinion from Legal Advisers. We may then wish to write to them outlining our intentions, before submitting to Ministers. Grateful for your views. On the point of informing Hong Kong, I was under the impression that Hong Kong is aware of our intention to bring the bequest back to the UK before 1997. Perhaps this is something which should be addressed more fully during the intended review of the UK/HK Scholarship scheme in 1994/5. Whatever the outcome, Hong Kong will still receive the interest on the S K Tang bequest to fund scholarships to the UK.
2. In her minute of 2 February to Michael Long, CRD, (asking for comments on the Sign Manual submission) Ms Haspel says that she has asked the Treasury Solicitor to ask the Solicitor General for his opinion on the idea of producing the Declaration of Trust as a 'sleeping document'. We are seemingly waiting for an opinion on this before sending the submission to Legal Advisers. I presume this request was the subject of a telephone conversation as there is nothing on file and we haven't as yet received a reply from the Treasury Solicitor. Are you able to shed any light on this?!
