1. You will have seen Edmund fosker's minute to me pf 11 June. I duly spoke to Springer yesterday the had just returned to his office from travelling). He said that he had recast the request so that it could be issued by an Alabama District Court, and had copied his draft to the Hong Kong Crown solicitor, with whom he wished to discuss detailed points of procedure He was also considering the possibility of putting a motion for reconsideration to the *High Court, which would have the benefit of short-

circuiting the procedure, though he did not yet know whether this approach was available under Hong Kong law. Apparently the motion would say that the request was now being made in the name of the Alabama District Court, and ask the High Court to reconsider its previous ruling.

I said that I was glad to hear that DoJ were working to keep the procedure on the kind of track we had proposed. Springer confirmed that this was his approach, but that he could not commit the Department of Justice at this stage. However, the Alabama prosecutor was willing to go along with Springer's line. I asked Springer to let us know if things developed differently.
