REPRINTING OF COLONIAL REGULATIONS

We want to ensure that the following 4 amendments are included in the reprinted version of the CRS.

(i) an amendment to CR93 to take account of the Limited Compensation Scheme. The Secretary of State has already approved this amendment so no action is needed.

(ii) an amendment to CR57 (3). This was apparently made in 1977. LRD are checking the files for me to ensure that the Secretary of State gave his approval, If he did, then no action is needed.

(iii) an amendment to CR66 to give effect to the Secretary of State's approval in June 1991 that the number of appointment and discipline cases that need to be referred to the FCO should be reduced. HKG have suggested an amendment and Miss Brooks is content with it. This will have to be submitted to the Secretary of State.

(iv) amendments to CR54(6) and CR65 to take account of the Judicial Officers (Tenure of Office) Bill which has now been introduced into LegCo. This bill also necessitates an amendment to the Letters Patent and Miss Brooks is aiming to get this to the 20 July Privy Council. This could cause a problem if we have to wait for the LPs to come into force before getting the Secretary of State's approval for the changes to the CRS, because Mr Herdman is planning to start the reprinting exercise in July. I will check with Hong Kong whether we can go ahead with the CRS before the LPs or whether they both have to be done at the same time. This will involve a submission to the Secretary of State.

2. Miss Brooks has suggested that it might be possible to submit to the Secretary of State on amendments (iii) and (iv) in the context of Mr Herdman's submission asking for approval of the draft re-printed version. I attach a draft minute to Mr Herdman on this point. I actually think it would be simpler if we submitted separately on these points, but I will wait to see what Mr Herdman says.

3. I also attach a draft letter to Hong Kong letting them know about the date of the Privy Council meeting and asking them about the timing of the amendments to the CRS.
