COMPOSITION OF THE 1995 LEGCO: PATENT AND ROYAL INSTRUCTIONS

1993 AMENDMENTS TO THE LETTERS

The Additional Instructions 1993 were approved at the Privy Council meeting which was held on 30 April 1993. The Letters Patent 1993 were also approved on 30 April 1993 at the same meeting.

The Foreign Secretary was commanded at the time of approval of the Additional Instructions to prepare them for Her Majesty's signature. They were signed on 20 June at St James's, according to Mr Stevens, Legal Executive Section.

The Letters Patent have not yet been signed. Please contact Mr Stevens (270-3080) in a few days' time to check the position.

The publication of the Letters Patent and Additional Instructions in the Hong Kong Gazette should be synchronised so that they come into operation together. It is provided that they come into operation on the date of publication in the Hong Kong Gazette. Accordingly, they need to be gazetted together, but must not be gazetted until the Letters Patent have also been signed (this is a complicated process involving the Royal Warrant, the Foreign Secretary and the Lord Chancellor).

You will recall the Letters Patent 1992 and Additional Instructions 1992 which were made at the Privy Council held in December 1992, were published by the Hong Kong Government in the Gazette and were unfortunately brought into force before royal signature. The Additional Instructions 1992 were signed on 24 March 1993 and the Letters Patent 1992 were signed on 15 April 1993.
