problem has arisen over the use of M 57 to Agrice buo senior police officers, Br. Vin Chi-hoi and ir. Jan Hin-kai, zho have failed to resume duty on the expiry of their approved leave. The facts of the two cases are as follows :

fr. win Chi-koi, Chief Inspector of folice, has been the subject of enquiries since July 1973 for suspected involvement in corrupt activities.

în early November 1973, he applied for permission to take casual leave from 12th to 17th November 1973 to visit the Philippines. Zis request xas approved by the Commissioner of Police as at that time there was insufficient evidence to substantiate the allegations against Hr. Din, and there was no indication that Mr. Sin would not return to his post when his leave expired.

Pr. Sin subsequently applied, through his wife who is still in long song, for an extension of leave to 30th November, and at tile came time submitted an application to resin by payment of one month's salary in lieu of notice, with effect from 300. November 1975 if an extension of

leave was approved, or ith effect from 12ta dovember 1973 if an extension of leave was not auproved. • cheque for one month's salary and his police warrant card were also hunded over by his wife.

Vader section 25(2) of the Police force ordinance (Chapter 232, Lass of long long) an officer in the inspectorate my resign by giving 3 months' notice in writing, or by the payment, with the "rior consent of the commissioner of Police, of one month's salary in lieu of novice. Mr. Sin had given no reasons for his resignation, the Comnisaioner of Police withheld his consent to Mr. Dia'a application. เอ wrote to ir. -in on 19th November 1973, care of his wife, returning the cheque and asking Nr. din to give reasons for his resi mution in percon. it the same time, hia salary was withheli with effect from 19th November, the date on thich he should have resumed duty.
