the second term as set out in the Basic Law, Annex 1. Secondly, it is based, except for the fourth sector, on organisations and corporate bodies. Thirdly, it embodies the principle of direct elections. The first two aspects are dealt with in paragraph 4 below and the third aspect is dealt with in paragraph 5.

The Election Committee for the second term described in the Basic Law, Annex I has four groups of sectors, each returning 200 members to the Election Committee. Taking as an example, the group of the industrial, commercial and financial sectors, it is proposed that each of these three sectors would return a proportion according to size (taking account of the number of persons associated with the sector or the number of organisations and corporate bodies within it) of the 200 members to be chosen from the group. If the sectors were approximately equal in size, each would return about 66 members but adjustments could be made to the number of members to be returned by each sector in order to reflect the relative size of that sector. Using the industrial sector as an illustration, one possibility might be to identify the various industries within it, such as the garment making industry, and allocate the organisations or corporate bodies within each industry a proportion determined by the size of the industry (according to number of persons or number of organisations within it) of the members allocated to the industrial sector. It may be necessary if there are too many organisations to allocate one member to a group of organisations. The important point is that the option would be based on organisations and corporate bodies within the industrial sector; how they are actually identified is not crucial. Identifying them through the various industries making up the industrial sector would be merely one way of approaching this matter. (Incidentally, while the better view may be that the Election Committee envisages only corporate bodies and organisations forming the constituent parts of the four sectors (see the Exco paper, Annex E paragraph 5), the Basic Law, Annexes I and II may be read as permitting organisations and corporate bodies in each sector to return Election Committee members while at the same time not excluding groups of individuals or individuals from returning members).

The third aspect of the proposal would involve direct elections. The members allocated to the various organisations or corporate bodies in a sector would be directly elected. There are various possibilities for holding direct elections and these are set out below.
(a) Every person associated with the organisations or
corporate bodies in a sector would vote for members returned by that sector.
