NATIONALITY REQUIREMENTS: UK PRACTICE

1. The Home Office inform me that in theory it is not illegal to stand as a candidate for election to the House of Commons if you are not a British National. However in practice returning officers require a candidate to make a statutory declaration that "I am acquainted with the provisions of the House of Commons Disqualification Act 1975, and to the best of my knowledge I am not ineligible to stand". Anyone who made a false declaration would be open to prosecution.

2.

The Home Office have pointed out that, unlike the BL, UK law permits dual nationals (such as Bryan Gould) to stand for parliament. They also tell me that it may be necessary to bring in new regulations in response to the Maastricht requirement that EC nationals be allowed to stand in Local and EC elections.
