Methods of Determining which of the

Legislators should be Removed

1.

This

note considers what might be the least objectional way, from our point of view, to determine which of the 1995 legislators should be removed from the 1997 legislature if, when they are vetted by the Preparatory Committee (PC), the legislature exceeds the 20% nationality provision in BL67. The following discussion is based on

the parameters that:

(a) BL67 is only implemented by the PC in respect of the 1997 legislature, and has no effect on the 1995 legislature.

(b) Any arrangements for determining which of the

This option envisages a Chinese pre-designating, preferably in advance of the 1995 LegCo elections, 12 seats (i.e. 20% of total Legco membership) which may be filled by non-Chinese nationals or those with foreign right of abode (for convenience they will be referred Lo as "foreigners" throughout this note).
