1.
You will have seen from Hong Kong Telno 73 (further copy attached) that the Governor directed during the meeting of EXCO on 15 January that a legal view be sought from the FCO on one point discussed at that meeting. This is the question of whether it would be incompatible with the UK's undertakings under the International Covenant on Civil and Political Rights to move to a position where voters in Hong Kong had to choose whether to exercise their vote in a geographical or a functional constituency. I attach a note by Hong Kong's Attorney General, and a separate opinion by Mr David Edwards,
2. I would be grateful for your views, in a form which can be transmitted to the Governor in Hong Kong.
