(3) Where the poll at polling stations is adjourned pursuant to a declaration by the Governor under section 26A(I) of the Ordinance, regulation 36C(4), (5) and (6) shall apply in respect of such adjournment as it applies in respect of an adjournment under regulation 36C(1).”.

(p) In regulation 46A(1)~

(i) repeal "Governor" and substitute "Boundary and

Election Commission";

(ii) in subparagraph (a) repeal “riol, open violence," and

substitute "a";

(iii) repeal "he" and substitute "it".

(4) In regulation 46A(2) repcal “Governor" and substitute

"Boundary and Election Commission”.

(r) In regulation 46A(3) repeal “7” and substitute "14".

(s) In regulation 46A(5) repeal “Governor" and substitute

"Boundary and Election Commission". (1) Add-

"46C. Procedure for adjournment by Governor of count at the counting stations

(1) An adjournment of counting of the votes at counting stations under section 26A(1) of the Ordinance shall be by a notice by the Governor published in the Gazelle or if such publication is not practicable in the circumstances, by the publication of a notice by him (substituted notice) by some other

means.

(2) The appointment of a date for the counting of votes for the purposes of section 26A(2) of the Ordinance shall be made either in the notice or substituted notice adjourning such counting and referred to in paragraph (1) or in some other notice by the Governor published in the Gazette as soon as practicable thereafter, or if such latter notice is not practicable in the circumstances, by the publication of a notice by him by some other means.

(3) Where the counting at the counting stations is adjourned pursuant to a declaration by the Governor under section 26A(1) of the Ordinance, regulation 46A(4), (5) and (6) shall apply in respect of such adjournment as it applies in respect of an adjournment under regulation 46A(1).".

(1) In regulation 51(3)(b) add "and to the Boundary and

Election Commission" after "Chief Secretary".

Electoral Provisions (Election Peition) Rules 1991 (L.N. 345 of 1991)

(a) in rule 6(2)(a)(i) add “and to the Boundary and Election

Commission" after “Legislative Council Chamber".

(b) In rule 6(2)(a)(ii) add “and to the Boundary and Election

Commission" after "respectively".

In rule 11(4)(d)(i) add “and to the Boundary and Election Commission" after "Chief Secretary".
