Amendment
(2) Where an election, poll or count is postponed or adjourned pursuant to subsection (1), the Governor shall appoint a date for the holding of an election, poll or count in place of the postponed or adjourned election, poll or count, which shall be not later than 14 days from the date on which the election, poll or count would have been held if not for such declaration.".
(p) Repeal section 28 and substitute—–
"28. Power to make regulations
The Governor in Council may by regulation provide for, as regards an election-
(a) the amount of any deposit and the
disposal of such deposit;
(b) the number or qualifications of subscribers for a nomination paper;
(c) the particulars of any system of voting and counting provided for in this Ordinance; and
(d) the determination of an election
result.".
(q) In section 35(2) add "and the Boundary and Election
Commission" after "Secretary".
(r) Repeal section 35(3) and substitute-
"(3) The Court may make a report as to any matter arising in the course of the trial of an election petition-
(a) of its own motion, to the Governor and
the Boundary and Election Commission where in the opinion of the Court such a report ought to be so made; or
(b) at the request of the Governor or the Boundary and Election Commission, to the Governor or the Boundary and Election Commission, as the case may bc.".
(s) In section 39 add "or the Boundary and Election
Commission" after “Secretary”.
(a) In section 2(1), in the definition of "Regional Council area" repeal "District Boards Ordinance (Cap. 366)" and substitute "Regional Council Ordinance (Cap. 385)".
(b) In section 2(1), in the definition of “Urban Council area" repeal "District Boards Ordinance (Cap. 366)" and substitute "Urban Council Ordinance (Cap. 101)”. (c) In section 2(1) add-
"Boundary and Election Commission" means the Boundary and Election Commission established under section 3 of the Boundary and Election Commission Ordinance ( of 1993);".
(d) In section 3(1)~
(i) repeal paragraph (aa)(ii) and (iii);
(ii) in paragraphs (a) and (b) repeal “of a District”.
