FOREIGN AFFAIRS COMMITTEE (FAC):

CHINA AND HONG KONG

EVIDENCE FROM FCO LEGAL ADVISERS: 3 NOVEMBER

1.

Mr Goodlad has agreed that Mr Chamberlain and Mr Hum should give evidence to the FAC on the compatibility of the Governor's constitutional proposals with the Joint Declaration, Basic Law and 1990 exchanges. Ms Barrett and Mr David Edwards (Hong Kong) should accompany. The evidence session will take place at 1030 on Wednesday 3 November in Committee Room 17 at the House of Commons. It will be public.

2. The Committee will hold another evidence session immediately following ours. This will be with a panel of lawyers namely, Peter Duffy (Barrister dealing in HK law), Perry Keller (University of Manchester) and Dr Peter Slinn (Head of Law Dept at SOAS). The aim is to complete both sessions before lunch. The Clerk has said that there would be no objections if FCO officials wished to remain to hear the session with the panel. (For the record, the evidence session with the June 4th China Support Group which was also to have taken place that morning, has been postponed probably until December).

3. House of Commons passes will not be necessary. Subject to the views of our witnesses I stand ready to escort the FCO team, plus any other interested officials, to the House. If this helps might I suggest that we meet outside the Slope Entrance at the top of King Charles Street at 1010 that morning.
